In accordance with the terms of Organic Law 15/1999 of 13 December on Protection of Personal Data (hereinafter ‘the LOPD’) and Royal Decree 1720/2007 of 21 December approving the Regulations of the LOPD (hereinafter ‘the RDLOPD’), USJ wishes to inform users of the Website regarding its policy for processing and protection of personal data of persons who voluntarily provide their contact details, use email to contact USJ, fill in information request forms, use the services available to members of USJ or any other service on the Website that involves communication of personal data to USJ. This policy shall include any information or consent forms included in any data request form on this Website or included in any specific terms for use of certain services.
The user is also hereby informed that this policy is deemed to be of complementary and subsidiary application in cases where other special terms are established via registration forms, contract terms or conditions of specific services.
PARTY RESPONSIBLE FOR THE INFORMATION
The UNIVERSITY OF SAN JORGE hereby informs users of the Website of the existence of various databases with personal data, the responsible party of which is USJ, domiciled at Campus Universitario Villanueva de Gállego, Autovía A-23 Zaragoza- Huesca, km. 299, 50830 Villanueva de Gállego (Zaragoza), with Tax Identification Number (CIF) G-99047672 and registered in the Register of Foundations of the Autonomous Community of Aragón by virtue of the Order of 9 March 2005 (Official Gazette of the Government of Aragón (BOA) of 23 March 2005) of the Department of the Presidency and Institutional Relations of the Government of Aragón.
PURPOSE OF THE PROCESSING OF PERSONAL DATA
Users are not obliged to provide personal data in order to use the Website. Accordingly, the communication of personal data for such purpose is deemed to be offered voluntarily in order to browse or make personal use of the services.
INFORMATION AND CONSENT
If the user does not have any legal relationship with USJ, it must be taken into account that the sending of an email to addresses published on the Website and communication by the user to USJ of personal data by any means implies their free, unequivocal, specific, informed and express consent to the processing of their personal data by USJ.
The user guarantees that the data provided is correct and up-to-date and corresponds to their own personal data and not that of third parties.
In general and without limitation, the personal data of users may be processed for the following purposes:
- If the user contacts USJ to make enquiries or request information, such data processing will be carried out in order to reply to the communications received and send the information requested.
- If the user sends their curriculum vitae, the data provided in that document and/or requested via the procedures established on the Website will be processed in order to evaluate and where applicable allow their participation in selection processes.
- If the user fills in registration forms for courses or programmes included in the range of educational services, events or activities offered by USJ, this data will be used to manage the corresponding request and process the registration.
- If the data is provided for the use of online services, the data will be processed to manage the use of that service, which may include authentication of the identity of the user and/or sending of passwords to allow access and use of the service, along with any other purposes directly or indirectly deriving from the service in question.
- When the user expressly accepts that it wishes to receive advertising relating to courses, programmes and/or services and activities offered by USJ, their data will be processed to manage sending of such information, possible revocation of user consent, opposition to the processing of their data or cancellation of the service.
As indicated, in the event of requests for personal data in relation to the provision of specific services offered via the Website, USJ shall include information in the data request form indicating the conditions for processing of that data in accordance with article 5 of the LOPD, and the user shall be deemed to have granted their consent for such processing upon voluntarily completing the data requested.
TRANSFER OR COMMUNICATION OF PERSONAL DATA
USJ may only transfer or communicate data as required under article 11.2.c of the LOPD to meet its obligations to public authorities in accordance with the applicable legislation and authorities responsible for regulating protection of data, telecommunications and the information society, judges, public prosecutors, courts, courts of auditors or ombudsmen.
In the case of provision of certain services such as registration for courses, programmes or activities offered by USJ jointly with third parties, the data of the interested party may be communicated to such third parties for the correct provision of the service, respecting at all times the security measures imposed by the applicable legislation governing protection of personal data.
Any other transfer of data shall be notified to the user by expressly informing them of the parties receiving the information, the purpose of the transfer and the nature of the data transferred or, where required by the LOPD, requesting their unequivocal, specific and informed consent. The user must pay special attention to the information which is provided in personal data forms published on the Website.
USJ shall not be held liable for processing of personal data carried out by third parties that establish hyperlinks with USJ, nor by parties who send users to their website via hyperlinks on the Website.
Nor shall USJ be held liable for processing of personal data by third parties to whom USJ communicates user data due to their status as a collaborator or co-owner of a programme or course for which the user has registered.
The user is hereby informed that data processing of USJ pages, profiles or accounts on social networks shall be governed by the corresponding policies and terms of the official website and the provider and owner of each social network, which shall also be responsible for the personal data of the user that is processed on the official website.
PERSONAL DATA PUBLISHED ON THE WEBSITE
Any personal data (including images, videos, texts, data and any other information) may only be used by the user for the purpose of participating and enjoying the Website in the manner established in this policy, or where applicable, the specific terms governing certain services, for private use and in accordance with the applicable law and not for financial or commercial gain. Any use made of the Website other than the uses indicated herein is expressly prohibited, including incorporation of images or data in personal databases or files and/or sending advertising or granting information to third parties without prior consent of the user owning such data. USJ shall not be held liable for use made by the user or third parties using the Website which is contrary to the terms indicated herein.
USJ hereby notifies the user that, with the exception of representation duly established by law, they may not use the identity or communicate the personal data of another person, and if email is used they may only include personal data corresponding to their own identity which is adequate, relevant, up-to-date, exact and true, and the user is solely liable for any direct or indirect damage caused to third parties or USJ arising from the use of the personal data of another person or use of their own data which is false, erroneous, out-of-date, inadequate or irrelevant, or due to communication of the user’s user name and password to other users or third parties.
The user is the only source of information regarding its personal data and USJ therefore requests that, in order to keep their data up to date in accordance with the LOPD, users notify any variation thereof to the address indicated for the exercise of the rights of access, rectification, cancellation and opposition.
DATA OF MINORS AND INCOMPETENT PERSONS
If the user is a minor or incompetent, USJ hereby informs the user that they require the consent of their parents, guardians or legal representatives to provide their personal data, and USJ shall not be held liable for the actions of such persons in the absence of such consent.
EXERCISE OF RIGHTS
The user is hereby informed that they may exercise their rights of access, rectification, cancellation and opposition by writing to FUNDACION UNIVERSIDAD SAN JORGE, domiciled at Campus Universitario Villanueva de Gállego, Autovía A-23 Zaragoza- Huesca, km. 299, 50830-Villanueva de Gállego (Zaragoza), or by writing to the email firstname.lastname@example.org, specifying the request or the right they wish to exercise together with a copy of their national identity document or other document certifying their identity.
Users that have expressly authorised USJ to send commercial communications by email may in accordance with articles 21 and 22 of the Law on Information Society Services and Electronic Commerce oppose the processing of their data for promotional or commercial purposes and revoke their consent at any time by writing to the following email: email@example.com
UPDATING OF THIS POLICY
Any modification of this policy shall be published on the Website and the user shall be responsible for periodically accessing the website to confirm the terms of the latest version.
